Privacy Policy

This Privacy Policy explains how Breakthrough Music School LLC ("Breakthrough," "we," "us," or "our") collects, uses, and shares information through the Breakthrough Music School Portal (the "Portal").
1. Information we collect
Account information: name, email address, phone number, password (stored encrypted), and role (parent, instructor, or admin).
Student information: a student’s full name, date of birth, instrument(s), enrollment status, and lesson history — provided by a parent/guardian or by Breakthrough Music staff.
Scheduling data: lesson bookings, instructor availability, locations/rooms, and reschedule or cancellation requests.
Lesson content: recap notes and, where uploaded, audio/video lesson recordings.
Communications: messages sent within the Portal, and records of email/SMS/push notifications sent to you.
Billing information: invoice and payment status synced with QuickBooks Online. We do not collect or store card numbers or bank account numbers on our own servers — online payments are completed directly on QuickBooks’/Intuit’s hosted, secure payment page.
Technical & security data: login timestamps and IP-based rate-limiting records (to protect accounts from unauthorized access attempts), session cookies, and, if you enable them, push-notification subscription details for your device/browser.
2. How we use information
We use this information to provide and operate the Portal (scheduling, lesson tracking, billing); communicate with you about lessons, billing, and account activity; maintain the security of accounts; and improve the Service.
3. How we share information
We share information only as needed to operate the Portal, with service providers acting on our behalf:

We do not sell your personal information, and we do not use it for third-party advertising.
4. Children’s information
The Portal is intended for use by parents/guardians, instructors, and school staff — not directly by children. Information about a student (including date of birth) is provided by their parent/guardian or by Breakthrough Music staff, not collected directly from the child. If you believe a child has provided us information directly without parental involvement, contact us and we will address it.
5. Communications & opt-out
We send SMS text messages only to users who have expressly opted in through the notification preferences in their account. Providing a phone number does not by itself enroll you in text messages. When you opt in, we record the exact disclosure you agreed to, the date and time, and the IP address and browser it was submitted from — that record is how we evidence your consent if a mobile carrier or regulator asks for it.
Text messages from Breakthrough Music School are account notifications only: reminders for upcoming lessons, scheduling changes, and billing notices. We do not send marketing or promotional texts. Message frequency varies with your account activity. Message and data rates may apply. Reply STOP to any message to cancel, or HELP for help.
We do not sell, rent, or share your mobile phone number or your SMS opt-in information with third parties or affiliates for their own marketing or promotional purposes. The only third party that receives your number is Twilio, which delivers the messages on our behalf.

6. Cookies & similar technologies
The Portal uses a session cookie to keep you signed in; we do not use third-party advertising or tracking cookies.
7. Data retention
We retain account and student information for as long as needed to provide the Service and to meet our recordkeeping, tax, and legal obligations, and delete or anonymize it thereafter.
8. Data security
We use industry-standard safeguards — including encryption of stored credentials and role-based access controls — to protect information. No system is completely secure, and we cannot guarantee absolute security.
9. Your choices
You may review and update your account information within the Portal, or contact us to request access to, correction of, or deletion of your information, subject to our legal and recordkeeping obligations.
10. Changes to this policy
We may update this Privacy Policy from time to time; the "Effective date" above reflects the latest revision.

Terms of Service

These Terms of Service ("Terms") govern access to and use of the Breakthrough Music School Portal (the "Portal" or "Service"), operated by Breakthrough Music School LLC ("Breakthrough," "we," "us," or "our"), a Texas limited liability company located at 1275 Arrington Road, College Station, TX 77845. By creating an account or otherwise using the Portal, you ("you" or "User") agree to these Terms.
1. Who may use the Portal
The Portal is provided for use by parents/guardians of enrolled students, Breakthrough Music instructors, and Breakthrough Music administrative staff. Accounts are issued to adults; the Portal does not knowingly permit account registration by children. Information about a minor student (such as name, date of birth, and lesson history) is entered and managed by that student’s parent or guardian, or by Breakthrough Music staff on their behalf.
2. The service
The Portal helps manage music lesson scheduling, attendance, lesson notes and recordings, family/instructor communication, contracts, and billing for Breakthrough Music. Features and availability may change over time.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at admin@breakthroughmusicschool.com if you suspect unauthorized use.
4. Billing & payments
Where the Portal integrates with our accounting system (QuickBooks Online) to generate invoices or account statements, any online payment is completed on QuickBooks’/Intuit’s own secure, hosted payment page — Breakthrough Music does not receive or store your card number or bank account number.
If you enroll in a recurring billing plan (e.g., monthly tuition), the amount, frequency, and next charge date will be disclosed to you at enrollment, and you may cancel or modify a recurring plan at any time by contacting us. It is your responsibility to keep your payment method current; a declined or expired payment method may result in a pause or cancellation of lesson services.
5. Communications
Opt-in is express and separate. We send text messages only to users who have specifically asked to receive them. Giving Breakthrough Music School a phone number does not by itself enroll you in text messages, and agreeing to these Terms is not agreement to be texted. You opt in by ticking the SMS consent box in your account's notification preferences, and we record the exact wording you agreed to along with the date and time. Consent to receive text messages is not a condition of enrolling in or purchasing lessons.
What you will receive. Account notifications about lessons — reminders ahead of an upcoming lesson, scheduling and cancellation notices, and billing notices. We do not send marketing or promotional text messages.
Message frequency. Varies with your account activity; typically a few messages a month.
Cost. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
How to stop. Reply STOP to any message to cancel at any time, or turn text notifications off in your account's notification preferences. Reply HELP for help, or contact us at admin@breakthroughmusicschool.com. Opting out of text messages does not affect your email or in-app notifications.
Your mobile number. We do not sell, rent, or share your mobile phone number or your SMS opt-in information with third parties or affiliates for their own marketing or promotional purposes. The only third party that receives your number is the messaging provider that delivers the message on our behalf.
6. User content
Instructors and admins may upload lesson recap notes and recordings (audio/video) associated with a student’s lessons. You retain ownership of content you upload; you grant Breakthrough Music a license to store, process, and display that content within the Portal for the purpose of providing the Service to the relevant family and instructor.
7. Acceptable use
You agree not to misuse the Portal — including attempting unauthorized access to another user’s account or data, uploading unlawful or infringing content, or interfering with the Portal’s normal operation.
8. Third-party services
The Portal relies on third-party service providers to operate, including QuickBooks Online (Intuit) for accounting and invoicing, Twilio for SMS delivery, Amazon Web Services (SES) for email delivery, and Google (Gmail API) for our administrative inbox integration. Your use of features that route through these providers is also subject to their respective terms.
9. Disclaimers
The Portal is provided "as is." We do not guarantee the Service will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Breakthrough Music is not liable for indirect, incidental, or consequential damages arising from use of the Portal.
11. Termination
We may suspend or terminate access to the Portal for violation of these Terms or as needed to operate our business (e.g., a family’s enrollment ending).
12. Changes to these terms
We may update these Terms from time to time; continued use of the Portal after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
